Terms & Conditions of Use
By downloading, accessing, or using any Speakify English service — including the mobile application, student portal, or any associated platform — you unconditionally accept these Terms & Conditions and our Privacy Policy. If you do not agree, you must not use any of our services.
1. About Speakify English
Speakify English is an online English language training platform operated as a sole proprietorship by Dr. Muskaan Advani Nayyar (“Proprietor”, “we”, “us”, “our”), registered and operating from Nagpur, Maharashtra, India. All services — including the mobile application and the web-based student portal — are intended exclusively for enrolled students. Any unauthorised access is strictly prohibited and may attract legal action under the Information Technology Act, 2000.
2. Eligibility and Account
2.1 You must be 18 years of age or older to independently create an account. If you are below 18, verifiable consent from a parent or legal guardian is required prior to enrolment. Such guardian shall be jointly responsible for all obligations under these Terms.
2.2 Access is granted solely to individuals who are formally enrolled in a Speakify English programme. Your login credentials are personal and non-transferable. Sharing login credentials with any third party constitutes a material breach of these Terms and will result in immediate account suspension without refund.
2.3 You agree to provide accurate, complete, and up-to-date registration information at all times. Accounts found to contain false, misleading, or impersonation information may be suspended or permanently terminated without notice.
2.4 You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at support@speakifyenglish.com if you suspect unauthorised use of your account.
3. Enrolment, Fees, and Payments
3.1 All fees are quoted and charged in Indian Rupees (INR), inclusive of applicable Goods and Services Tax (GST), unless explicitly stated otherwise.
3.2 Payments are processed via Razorpay and UPI. By making a payment, you additionally agree to the applicable terms of those payment processors. Speakify English does not store full payment card or bank account details on its own servers.
3.3 All fees paid are non-refundable unless explicitly confirmed in writing by Speakify English. Any refund, if granted, is at the absolute discretion of the Proprietor and shall not constitute a precedent for future refunds.
3.4 Payment disputes must be raised in writing to support@speakifyenglish.com within 7 (seven) calendar days of the transaction date. Disputes raised after this period will not be considered.
3.5 Speakify English reserves the right to revise pricing at any time with reasonable prior notice. Continued use of the Services after any price revision constitutes your acceptance of the revised pricing.
4. Session Booking, Cancellation, and Rescheduling
4.1 Sessions must be booked through the student app or portal. A booking is confirmed only upon receipt of a written confirmation notification.
4.2 Cancellations made fewer than 2 (two) hours before the scheduled session start time may result in forfeiture of that session, at the Proprietor’s discretion.
4.3 Rescheduling is permitted a maximum of 2 (two) times per enrolment period per session. Requests beyond this limit will not be accommodated, and the session will be deemed forfeited.
4.4 Repeated no-shows — defined as absence without prior cancellation — may result in suspension of booking privileges or termination of enrolment without refund.
4.5 Speakify English reserves the right to reschedule or cancel sessions due to trainer unavailability, technical issues, platform maintenance, or force majeure events. A replacement session will be offered at no additional cost. No monetary compensation will be payable for such cancellations.
5. Intellectual Property
5.1 All course content, materials, session recordings, lesson plans, assessments, and branding associated with Speakify English are the exclusive intellectual property of Dr. Muskaan Advani Nayyar, protected under the Copyright Act, 1957 and other applicable Indian and international laws.
5.2 You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to access content solely for your own educational purposes as part of your enrolled programme. This licence does not transfer any ownership rights.
5.3 You may not copy, reproduce, distribute, publicly display, sell, modify, or create derivative works from any content without the prior written consent of the Proprietor.
5.4 Sharing content via screenshots, screen recordings, messaging platforms, social media, or any other channel is strictly prohibited. Violations may attract civil and criminal proceedings under the Copyright Act, 1957 and the Information Technology Act, 2000.
5.5 The Speakify English name, logo, sub-brands (including Fluent Buddies), and associated trademarks are the sole property of Dr. Muskaan Advani Nayyar. Unauthorised use is strictly prohibited.
6. AI Tutor — Speako
6.1 Our Services include Speako, an AI-powered English tutoring feature. Speako uses large language models provided by third-party AI infrastructure providers. By using Speako, you expressly consent to your conversation inputs being transmitted to and processed by these third-party systems.
6.2 Speako is a supplementary educational tool only. AI-generated responses may contain inaccuracies, errors, or outdated information. Speakify English makes no warranty as to the accuracy, completeness, or fitness for purpose of any AI-generated content.
6.3 You must not use Speako for any unlawful, harmful, abusive, defamatory, or offensive purpose. Any attempt to manipulate, jailbreak, reverse engineer, or misuse the AI system is strictly prohibited and may result in immediate account termination.
6.4 Speakify English accepts no liability for any action taken or omission based on AI-generated content. Conversations may be logged for up to 90 days for quality assurance and safety monitoring purposes.
7. User Conduct
7.1 You agree to use all Services only for lawful purposes and in a manner that respects the rights of Speakify English, its staff, and other users.
7.2 The following actions are strictly prohibited:
- Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.
- Harassing, abusing, threatening, or causing distress to trainers, staff, or other students.
- Attempting unauthorised access to any part of the platform, databases, or server infrastructure.
- Using automated tools, bots, scripts, or scrapers to access any part of the Services.
- Uploading or transmitting malicious code, viruses, or any harmful software.
- Engaging in any conduct that disrupts, degrades, or interferes with the operation of the Services.
- Posting or transmitting any content that is defamatory, obscene, or violates any third-party rights.
7.3 Speakify English reserves the right to monitor usage for compliance with these Terms and may report illegal activity to relevant authorities.
8. Disclaimer of Warranties
8.1 All Services are provided on an “as is” and “as available” basis. Speakify English makes no representation or warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
8.2 Speakify English does not warrant that Services will be uninterrupted, error-free, secure, or free from viruses. Speakify English does not guarantee any specific learning outcomes, performance improvements, or results from use of the Services.
9. Limitation of Liability
9.1 To the fullest extent permitted by applicable law, Speakify English, the Proprietor, trainers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, loss of goodwill, or business interruption.
9.2 Speakify English’s total aggregate liability for any claim arising from or relating to the Services shall not exceed the total fees paid by you in the 3 (three) months immediately preceding the date the claim arose.
9.3 Nothing in these Terms shall limit or exclude liability for fraud, death, or personal injury caused by our negligence to the extent such limitation or exclusion is prohibited by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Speakify English, the Proprietor, trainers, employees, and agents from all third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or relating to: (a) your use or misuse of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit, post, or transmit through the Services.
11. Termination
11.1 Speakify English may suspend or permanently terminate your access to the Services at any time, with or without notice, for any breach of these Terms, misconduct, non-payment, or otherwise at the Proprietor’s sole and absolute discretion. Termination does not entitle you to any refund of fees paid.
11.2 Upon termination, your licence to access the Services and all content ceases immediately. Provisions of these Terms that by their nature should survive termination (including Sections 5, 9, 10, 12) shall continue in effect.
12. Governing Law and Dispute Resolution
12.1 These Terms are governed by and shall be construed in accordance with the laws of the Republic of India, without regard to conflict of law principles.
12.2 In the event of any dispute, the parties shall first attempt good-faith resolution through direct negotiation. If a dispute is not resolved within 30 (thirty) days, it shall be subject to the exclusive jurisdiction of the competent courts located in Nagpur, Maharashtra, India.
13. Force Majeure
Speakify English shall not be liable for any failure or delay in performance resulting from circumstances beyond its reasonable control, including but not limited to acts of God, government action, internet outages, power failures, pandemics, or natural disasters.
14. Modifications
Speakify English may modify these Terms at any time. The revised Terms will be published with an updated effective date. Where material changes are made, we will make reasonable efforts to notify you. Continued use of the Services after the revised Terms are published constitutes your acceptance of the changes.
15. Severability
If any provision of these Terms is found invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable. The remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Speakify English with respect to the Services and supersede all prior negotiations, representations, warranties, and understandings.
